BANNER COUNTY
BOARD OF EQUALIZATION PROCEEDINGS

The Banner County Board of Equalization met in regular session in the Commissioners’ room of the Banner County Courthouse on May 3, 2016. This is in accordance with the adjournment of the April 19, 2016 meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE at the Post Office, the Banner County School, and at the clerk’s office and on the front window of the Banner County Courthouse.  Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk.  A copy was emailed to each board member on April 29, 2016.  The agenda was not amended less than 24 hours prior to the meeting.

The chairman called the meeting to order at the hour of 8:30 a.m. Present on roll call were: Chairman Robert J. Gifford; Vice Chairman John-Robert Faden; Member Robert Post; Sharon Sandberg, Assessor; Toney Krajewski, Assistant Highway Superintendent, and Lori Hostetler, Clerk.  Also present at various times: Jim Zimmerman, Attorney via telephone; Tom Neal, Highway Superintendent, and Monty Stoddard, Treasurer.

The chairman stated that the open meetings law is posted on the meeting room wall and that paper copies are available on the table by the door.

The agenda was examined, and Faden moved to approve as presented. Second by Post.  Roll call vote: Post, yes; Faden, yes; Gifford, yes.

The minutes of the previous meeting had been supplied to each board member. Post moved to approve the minutes for April 19, 2016 and that the actions therein be ratified. Second by Faden. Roll call vote: Faden, yes; Gifford, yes; Post, yes.

Protest of personal property tax from High West Energy

ITEMS OF BUSINESS BEFORE THE BOARD

Item #1 – Set date for High West Energy Protest Hearing - Jim Zimmerman, Attorney requested to go into executive session to discuss a legal matter.

Post made a motion to go into executive session for discussion of a legal matter at the request of the county attorney. Second by Faden. Roll call vote: Gifford, yes; Post, yes; Faden, yes.

Executive session was called to discuss a legal matter at 8:34 a.m. Those present included: Chairman Robert J. Gifford; Vice Chairman John-Robert Faden; Member Robert Post; Jim Zimmerman, Attorney via telephone; Sharon Sandberg, Assessor, and Lori Hostetler, Clerk.

Post made a motion to come out of executive session which was called to discuss a legal matter. Second by Faden. Roll call vote: Post, yes; Faden, yes; Gifford, yes.

No action was taken.

8:57 a.m. - Regular meeting was resumed.

Gifford made a motion to set the date for High West Protest Hearing for May 17, 2016 at 9:00 a.m. Second by Faden. Roll call vote: Post, yes; Gifford, yes; Faden, yes.

Item #2 – Assessment Roll corrections - Sharon Sandberg, Assessor presented a list of assessment roll corrections. Faden made a motion to approve the assessment roll corrections. Second by Post. Roll call vote: Gifford, yes; Post, yes; Faden, yes.

Post made a motion to adjourn the Banner County Board of Equalization meeting at 8:59 a.m. Second by Faden.  Roll call vote:  Post, yes; Gifford, yes; Faden, yes. The next meeting will be held in regular session on May 17, 2016 or at the call of the clerk.  A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.

ITEMS OF BUSINESS BEFORE THE BOARD

Item #1 – Reconsider denial of claim by High West Energy – Tabled.

Item #2 – Discussion and possible action on repair or replacement of air conditioner/furnace unit – After reviewing the options, Post made a motion to replace the furnace/air conditioner according to the bid proposal received from Oregon Trail, with the stipulation that the bill would not be received until July 1st. Second by Faden. Roll call vote: Faden, yes; Post, yes; Gifford, yes.

Item #3 – Discussion of hiring a road employee with more experience – After discussion, Post made a motion to advertise for an experienced grader/operator with the possibility of that person getting a Class B Highway Superintendent License. Second by Faden. Roll call vote: Post, yes; Faden, yes; Gifford, yes.

REPORTS

HIGHWAY SUPERINTENDENT
Tom Neal, Highway Superintendent stated that he has not yet hired anyone for the mowing position. It was decided to advertise again. He reported on the cost to replace the motor on the John Deere machine. There was discussion on the condition of the county graders and the need for a newer machine. There was also discussion that Tom would like to put in a culvert on Road 18, five miles west of Harrisburg.

TREASURER
Monty Stoddard, Treasurer reported that tax collections went well. He said he would be attending a workshop and meeting in June and will be looking at legislation that is presented.


SHERIFF
The Sheriff’s Quarterly Fee Report was received.

COUNTY CLERK
Lori Hostetler, Clerk reported that she is doing final preparations for the election to be held on May 10th, and she has put the Emergency Manager information on the county website. She stated that the jury trial has been rescheduled for June 16th. Since that day falls in the middle of the dates scheduled for Clerk’s Summer Workshop, she will not be able to attend this year.
