BANNER COUNTY
COMMISSIONERS PROCEEDINGS
The Banner County Board of Commissioners met in regular session in the Commissioners’ room of the Banner County Courthouse on April 5, 2016. This is in accordance with the adjournment of the March 15, 2016 meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE at the Post Office, the Banner County School, the clerk’s office, and on the front window of the Banner County Courthouse. Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.
The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk. A copy was emailed to each board member on April 1, 2016. The agenda was not amended less than 24 hours prior to the meeting.
The chairman called the meeting to order at the hour of 8:48 a.m. with the pledge of allegiance to the flag. Present on roll call were: Chairman Robert J Gifford; Vice Chairman John-Robert Faden; Member Robert Post; Jim Zimmerman, Attorney; Sharon Sandberg, Assessor; Tom Neal, Highway Superintendent; Toney Krajewski, Assistant Highway Superintendent; Monty Stoddard, Treasurer; and Lori Hostetler, Clerk. Also present at various times: Art Olsen.
The chairman stated that the open meetings law is posted on the meeting room wall and that paper copies are available on the table by the door.
The agenda was examined and Faden moved to approve. Second by Post. Roll call vote: Gifford, yes; Post, yes; Faden, yes.
The minutes of the previous meeting had been supplied to each board member. Post moved to approve the minutes for March 15, 2016 and that the actions therein be ratified: Second by Faden. Roll call vote: Post, yes; Faden, yes; Gifford, yes.

ITEMS OF BUSINESS BEFORE THE BOARD
Item #2 – Discussion on the road department’s work schedule – There was discussion on the procedure used to plow roads after a snow storm, when road employees are working a four day week. There was also discussion on the condition of the roads after such a wet snow.
REPORTS
HIGHWAY SUPERINTENDENT
Tom Neal, Highway Superintendent presented quotes for a chip seal coat on Stegal Road. He reported that the state has determined that there is another bridge in the county.
Item #1 – Discussion and possible action on claim for refund for 2015 personal property tax paid by High West Energy - Because there was a computer error on High West’s part when they filed their personal property schedule last year, they are requesting a refund. After discussion, Gifford made a motion to deny the claim for a refund of 2015 personal property taxes paid by High West Energy. Second by Faden. Roll call vote: Gifford, yes; Post, yes; Faden, yes.
ATTORNEY
Jim Zimmerman, Attorney requested to go into executive session to discuss a legal matter.
Bob Post made a motion to go into executive session for discussion of a legal matter at the request of the county attorney. Second by Faden. Roll call vote: Gifford, yes; Post, yes; Faden, yes.
Executive session was called to discuss a legal matter at 10:08 a.m. Those present included: Chairman Robert J. Gifford; Vice Chairman John-Robert Faden; Member Robert Post; Jim Zimmerman, Attorney and Lori Hostetler, Clerk.
Bob Post made a motion to come out of executive session which was called to discuss a legal matter. Second by Faden. Roll call vote: Post, yes; Faden, yes; Gifford, yes.
No action was taken.
10:17 a.m. - Regular meeting was resumed.
TREASURER
Monty Stoddard, Treasurer presented the pledged collateral.
COUNTY CLERK
Lori Hostetler, Clerk reported that early voter ballots are ready to be mailed out, and voters can early vote in office beginning on April 11th.
Items discussed not on the agenda: The evaluation process for the highway and weed superintendents.
Gifford made a motion to adjourn the meeting of the Banner County Board of Commissioners at 10:52 a.m. Second by Post. Roll call vote: Faden, yes; Gifford, yes; Post, yes. The next meeting will be held in regular session on April 19, 2016 or at the call of the clerk. A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.
