BOARD OF EQUALIZATION PROCEEDINGS

The Banner County Board of Equalization met in regular session in the Courtroom of the Banner County Courthouse on July 19, 2022. This is in accordance with the adjournment of the July 12, 2022, meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE, at the Post Office, the Banner County School, at the clerk’s office, and on the front window of the Banner County Courthouse. Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk. A copy was emailed to each board member on July 14, 2022. The agenda was not amended less than 24 hours prior to the meeting.

The Chairman called the meeting to order at the hour of 8:35 a.m. Present on roll call were: Bob Post, Chairman;

Bob Gifford, Vice-Chairman; Member Sharon Sandberg; Mark Kovarik, Attorney; Lisa Cross, Clerk; Tom Neal, Highway Superintendent.

The Chairman stated that the open meetings law is posted on the meeting room window and that paper copies are available on the table by the door.

The agenda was examined, and Sandberg moved to approve as presented. Second by Gifford. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

The minutes of the previous meeting had been supplied to each board member. Gifford moved to approve the minutes for July 5, 2022 regular session and July 12, 2022 Protest Hearings, and that the actions therein be ratified. Second by Sandberg. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes.

Gifford made a motion to adjourn the Banner County Board of Equalization meeting at 8:44 a.m. Second by Sandberg. Roll call vote: Post, yes; Gifford, yes; Sandberg, yes. The next meeting will be held in regular session on August 2, 2022, or at the call of the clerk. ITEMS OF BUSINESS BEFORE THE BOARD

1. Impoundment Yard for Sheriff – There was discussion about not finding a statute requiring of the impoundment yard being in Banner County. Bob Post contacted Sheriff Overman about contracting with Scotts Bluff County. He will get back to Bob. Sheriff, Stan McKnight, gave an estimate he received for $16,000.00 for a 75’ x 150’. Sheriff McKnight has more estimates coming. Once received he will present them. Sheriff McKnight can add the amount he needs to his proposed budget.

2. CDL Training for Road Department – Tom Neal, Highway Superintendent, reported that Kurt Tremain from Sidney teaches a class at the college. He has worked with other counties. He can offer the class online. The practical would be done here and documented. It would be $500.00 for class. Possibility of staying a year or paying back but isn’t enforceable.

3. Robin Darnall – ORION Agreement – Robin Darnall wants to learn about the ORION Agreement. At this point, the Commissioners have not viewed an agreement. Banner County doesn’t have zoning so there will likely be a developmental agreement to help address that. There will also be a road agreement that will address the upkeep of the roads. ORION will be bonded. Reed Buckley from ORION will be at the next meeting.

4. Chad Theis with Zelle Solutions HR Program – tabled.

COMMITTEE REPORTS

Office of Human Development – OHD held a normal meeting.

National NACO Committee – There will be a meeting in Denver this week. They will address the farm bill.

REPORTS

Highway Department – Tom Neal, Highway Superintendent, reported they are getting everything serviced up and moved to get culverts put in. They will begin installing culverts next week.

Weed Superintendent – There will be a letter for a thistle problem going out to a landowner.

County Attorney – Mark Kovarik, County Attorney, has been helping the Weed Superintendent with a letter concerning a thistle problem.

Clerk – Lisa Cross, Clerk, reported that things have been very busy with the extra meetings, year-end and budget. She is training the new girl and it is going very well.

Sheriff – Stan McKnight, Sheriff, said if he needs something that is necessary he will spend the money and if there isn’t enough in the budget there will have to be a meeting to address it.

Public Comments

Deborah Gentz – 2523 County Road 18, Harrisburg, NE 69345 – Deborah wanted more information concerning the letter going out about the thistle problem. It is complicated by a bankruptcy and being organic. The landowner is who is responsible for taking care of the weed problem, but where it is in bankruptcy it has to go thru proper channels.

Eddie Shaul – 2090 Road 25, Harrisburg, NE 69345 – Eddie would like to know if the Wind Energy people will be limited to what roads they are allowed to use. At this point, we don’t even know what roads there are requesting to use.

Barb Cross – 3323 Road 18, Harrisburg, NE 69345 – Barb requested to know what the claim for $10,000.00 to Baird Family Farm. The $10,000.00 is part of the contract for the Weed Superintendent. Barb also asked what the claim to the Kimball County Treasurer is for. That claim is for the Extension Office. She would also like to know how much the Zoom would be to keep for the meetings. She would like to see the Zoom continued with our meetings.

Bob Gifford – 3720 Road 34, Gering, NE 69341 – Bob Gifford, Vice-Chairman Board of Commissioners, spoke of why are we a county?? Good services, good roads, and controlling our own taxes are reasons he listed. We have struggles with hiring people, we don’t pay enough, taxes are too high are complaints he hears. We could join any county next to us and have lower taxes. We are supposed to have nine people on the fair board and haven’t had that for a while. Is it worth fighting for? We need to realize what a blessing we have.

Jerry Soule – 3253 Road 15, Harrisburg, NE 69345 – Jerry wanted to know about Baird Family Farm. Steve Baird is our Weed Superintendent. Steve has two grown sons that do the spraying and work. Steve’s wife does the paperwork. Jerry was given the phone number so he could contact them.

Ayden Vrtatko – 3512 County Road 18, Harrisburg, NE 69345 – There are weeds such as goat heads and sunflowers on County Road 18 by her house. Ayden wanted to know if Banner County will spray them, but they only spray for noxious weeds. The landowner would have to hire someone to spray it.

Stan McKnight – 406 State Street, Harrisburg, NE 69345 – Stan wanted to know if a landowner in town has bind weed in their yard are they responsible for taking care of it. Stan also asked if we need to be putting the ad for job applications in the Star Herald, but we use hireclick.com. Hireclick.com automatically puts the ad on our website and on our Facebook.

4. Chad Theis with Zelle Solutions HR Program - Chad Theis and Micah Neill spoke about what their company has to offer Banner County. The help with the recruiting and hiring, updating personnel policy manuals, disputes amongst the employees, along with many other things. The cost is $5,000.00 a month. You must stay a year according to the contract. There is no additional charges for anything. You can also pay to do certain projects. An example is to update the personnel policy manual it would be around $8,500.
