BANNER COUNTY
COMMISSIONERS  PROCEEDINGS

 The Banner County Board of Commissioners met in regular session in the Commissioners’ room of the Banner County Courthouse on March 3, 2015.  This is in accordance with the adjournment of the February 17, 2015 meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE at the Post Office, the Banner County School, the clerk’s office, and on the front window of the Banner County Courthouse.  Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

 The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk.  A copy was emailed to each board member on February 27, 2015.  The agenda was not amended less than 24 hours prior to the meeting.

The chairman called the meeting to order at the hour of 8:45 a.m. with the pledge of allegiance to the flag.  Present on roll call were Chairman Robert J Gifford; Vice Chairman John-Robert Faden; Member Robert Post; Tom Neal, Highway Superintendent; Carl Gilbert, Surveyor, and Lori Hostetler, Clerk. Also present at various times: Monty Stoddard, Treasurer and Stan McKnight, Sheriff.

 The chairman stated that the open meetings law is posted on the meeting room wall and that paper copies are available on the table by the door.

 The agenda was examined and Faden moved to approve. Second by Post. Roll call vote: Gifford, yes; Post, yes; Faden, yes.

 The minutes of the previous meeting had been supplied to each board member. Post moved to approve the minutes for February 17, 2015 and that the actions therein be ratified:  Second by Faden.  Roll call vote:  Post, yes; Faden, yes; Gifford, yes.

 ITEMS OF BUSINESS BEFORE THE BOARD                  

Item #1 – Discussion and possible action on the hiring of someone to conduct the county audit for the year ending June 2014 – After discussion, Post made a motion to approve FALCO to perform the audit for June 2014. Second by Faden. Roll call vote: Gifford, yes; Post, yes; Faden, yes.

 Item #2 – Discussion and possible action on the hiring of a groundskeeper and the wage to be paid – Lori Hostetler, Clerk presented the two applications which were received. After discussion, Faden made a motion to hire Gay Olsen at a salary of $325.00 a month for the months of April through September, with an optional performance bonus paid at the end of the season. Second by Post. Roll call vote: Gifford, yes; Faden, yes; Post, yes.

 Item #3 Discussion and possible action on changing the janitor and weed superintendent positions from salary to hourly– After discussing the requirements to be considered an exempt salaried employee, Post made a motion to leave the janitor as a non-exempt salaried employee and to make the weed superintendent hourly as required by the Fair Labor Standards Act. Second by Gifford. Roll call vote: Post, yes; Gifford, yes; Faden, yes.

 Item #4 - Discussion and possible action requiring surveys for Oil and Gas Certificates to set the corners using monument markers – Carl Gilbert, Surveyor presented examples of Oil and Gas Certificates that have been done and information on state statutes regarding surveys. He stated that he would like the county to require that all Oil and Gas Certificates are handled as land surveys, and all public land corners within the section would be set with monuments markers. In addition, all Oil and Gas Certificates would need to be approved by the county surveyor. The item was tabled.

 REPORTS

 COUNTY SURVEYOR
Carl Gilbert, Surveyor reported that he had set four corners in the county over the last 2 weeks.

 Item #5 – Discussion and possible action on the purchase of a pickup for the weed department – Tom Neal, Highway Superintendent presented information on available vehicles for sale that meet the requirements for the weed department pickup. After discussion, Gifford made a motion to purchase a 2008 Ford F-250 for the weed department. Second by Faden. Roll call vote: Post, yes; Gifford, yes; Faden, yes.

 COMMITTEE REPORTS
Bob Gifford reported that he had met the new Emergency Manager, Tim Newman.

HIGHWAY SUPERINTENDENT REPORT
Tom Neal, Highway Superintendent reported that he is waiting to hear on a Culvert/ Bridge Delineator Grant. He stated that he will be attending a bridge meeting in Kearney next month. He said that there are county roads that have areas that do not receive much sun and can remain icy in the winter months and discussed the possibility of adding signage. He also reported that the equipment operators were attending a motor grader training.

 COUNTY TREASURER REPORT
Monty Stoddard, Treasurer reported that he had collected $64,434 from the tax sale. He also stated that Kathy will be attending the Institute of Excellence.

 COUNTY CLERK REPORT
Lori Hostetler, County Clerk reported that she is waiting to hear that the county’s new health insurance plan is in effect. She also said that the county was selected for a retirement plan audit.

 No other reports. 

Faden made a motion to adjourn the meeting of the Banner County Board of Commissioners at 11:04 a.m.  Second by Post.  Roll call vote: Post, yes; Gifford, yes; Faden, yes.
