BANNER COUNTY
BOARD OF EQUALIZATION PROCEEDINGS

 The Banner County Board of Equalization met in regular session in the Commissioners’ room of the Banner County Courthouse on March 17, 2015. This is in accordance with the adjournment of the March 3, 2015 meeting and notice published in the Scottsbluff Star Herald and posting notices in Harrisburg, NE at the Post Office, the Banner County School, and at the clerk’s office and on the front window of the Banner County Courthouse.  Proof of publication is on file in the office of the County Clerk and is made a part of the proceedings by reference.

 The agenda for the meeting was kept current and was available during the regular business hours at the office of the County Clerk.  A copy was emailed to each board member on March 14, 2015.  The agenda was not amended less than 24 hours prior to the meeting.

 The chairman called the meeting to order at the hour of 8:33 a.m. Present on roll call were: Chairman Robert J Gifford; Vice Chairman John-Robert Faden; Member Robert Post; Tom Neal, Highway Superintendent; Jim Zimmerman, Attorney; Connie Soule, and Lori Hostetler, Clerk. Also present at various times: Lucky Taggart.

 The chairman stated that the open meetings law is posted on the meeting room wall and that paper copies are available on the table by the door.

 The agenda was examined, and Faden moved to approve as presented. Second by Post.  Roll call vote:  Post, yes; Gifford, yes; Faden, yes.

 The minutes of the previous meeting had been supplied to each board member. Faden moved to approve the minutes for March 3, 2015 and that the actions therein be ratified. Second by Post. Roll call vote:  Post, yes; Gifford, yes; Faden, yes.

 CORRESPONDENCE- None

 ITEMS OF BUSINESS BEFORE THE BOARD - None

 Faden made a motion to adjourn the Banner County Board of Equalization meeting at 8:42 a.m.  Second by Gifford.  Roll call vote:  Post, yes; Gifford, yes; Faden, yes. The next meeting will be held in regular session on April 7, 2015 or at the call of the clerk.  A full agenda of the matters to be considered at such date and time is kept continually current and is available for public inspection during normal business hours at the office of the Banner County Clerk in the Courthouse in Harrisburg.

 ITEMS OF BUSINESS BEFORE THE BOARD                 

Item #1 – Discussion on county website - Lori Hostetler, Clerk stated that the new website is up and is nearly finished. There was discussion that the old site needs to be removed. The new address of the Official Website for Banner County is: bannercountynegov.org.

 Item #2 – John Isom - Discussion on complaint against road employee – John Isom described an incident involving a county truck. He said that he had reported it to the highway superintendent and was not happy with how it was handled. There was discussion on the procedure used when a  complaint is received from the public, and the county attorney advised John to submit a written report of the incident to the county. Tom Neal, Highway Superintendent said that he went to the site of the incident and said that it was a bad intersection. He reported that he had a sign made warning of “trucks entering highway” and would be putting it up.

 Item #3 - Dick McGowan - Discussion on how complaints received on employees are handled– Dick McGowan, Weed Superintendent stated that on page 14 of the Personnel and Policy Procedure Manual, it addresses how a complaint should be handled. Donna McGowan read the page from the manual. It was observed that this particular section of the manual would apply to the situation addressed in agenda item #2. After further discussion, it was determined that agenda item #3  concerns employees complaining about other employees.

 Faden made a motion to go into Executive Session in order to prevent needless injury to the reputation of an individual.  Second by Post. Roll call vote: Post, yes; Faden, yes; Gifford, yes.

 Executive Session was called at 9:24 a.m. Present were Chairman Robert J Gifford; Vice Chairman John-Robert Faden; Member Robert Post; Tom Neal, Highway Superintendent; Jim Zimmerman, Attorney, and Dick McGowan, Weed Superintendent.

 Post made a motion to come out of Executive Session which was called for the prevention of needless injury to the reputation of an individual. Second by Faden. Roll call vote: Faden, yes; Gifford, yes; Post, yes.

 No action was taken.

 9:40 a.m. – Regular meeting was resumed.

 REPORTS

 COMMITTEE REPORTS
Bob Post reported that the Office of Aging is awaiting a new Health and Human Services Director.
Bob Gifford reported that Panhandle Public Health passed a resolution stating that they oppose fracking in Sioux County.

 HIGHWAY SUPERINTENDENT REPORT
Tom Neal, Highway Superintendent reported that they have been graveling on Road 26, and he would also like to gravel the south side of Wright’s Gap Road. He said that he had picked up the new weed spraying pickup, and they also plan to use it for signs.

 WEED SUPERINTENDENT
The commissioners accepted the resignation of Dick McGowan, Weed Superintendent.

 COUNTY CLERK REPORT
Lori Hostetler, County Clerk presented the clerk and the clerk of the district court fee reports. She reminded that Doug Leafgreen will be at the courthouse tomorrow to answer employee questions on the new HSA health insurance plan and reported that she has started the process to get the NACo Prescription Cards.

 COUNTY TREASURER REPORT
The Pledged Collateral Report and Tax Sale Report were received.

 No other reports.

 Faden made a motion to adjourn the meeting of the Banner County Board of Commissioners at 10:03 a.m.  Second by Post.  Roll call vote: Post, yes; Gifford, yes; Faden, yes.
