COMMISSIONERS PROCEEDINGS

The Banner County Board of Commissioners met in a special session on Thursday, September 14, 2023 at 10:00 a.m. in the courtroom of the Banner County Courthouse.

Notice of the meeting was published in the Western Nebraska Observer. Meeting notices posted in Harrisburg, Nebraska at: Post Office, Banner County School, and the Banner County Courthouse.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the Banner County Clerk.  A copy was emailed to each board member on Wednesday, September 13, 2023.

Chairperson Darnall called the meeting to order at 10:03 a.m. Roll call showed all members present. Also present: County Clerk Katie West; County Treasurer Kathy Natale; and Sheriff Zane Hopkins.

Chairperson Darnall stated that the Open Meetings Act is posted in the back of this courtroom by the entrance.

Gifford led prayer.

Pledge of Allegiance was said.

Agenda: The agenda for meeting was examined. Motion by Anderson to approve agenda. Second by Gifford. Roll call vote: Gifford yes; Anderson yes; Darnall yes. Motion carried.

Items of business before the board:

  1. Budget Hearing: Chairperson Darnall opened the budget hearing at 10:05 a.m. Gifford presented outlining key provisions of the proposed budget statement, including, but not limited to, a comparison with the prior year's budget. Chairperson Darnall opened the floor for public comment on the proposed budget statement. No public comments. All members of the public wishing to address the governing body were provided a reasonable amount of time to do so. Resolution 23 - 22 - Resolution of Adoption and Appropriations was read by Gifford.

    "Whereas a proposed county budget for the fiscal year of July 1, 2023 through June 30, 2024, prepared by the Budget Making Authority, was transmitted to the County Board on or about the 14th day of September 2023. Now, therefore, be it resolved, by the Board of Commissioners of Banner County, Nebraska as follows:

    Section 1. That the budget for the Fiscal Year July 1, 2023 to June 30, 2024, as categorically evidenced by the Budget Document be, and the same hereby is adopted as the Budget for Banner County for said fiscal year.

    Section 2. The the offices, departments, activities, and institutions herein named are hereby authorized to expend the amounts herein appropriated to them during the fiscal year beginning July 1, 2023 and ending June 30, 2024.

    Section 3. That the income necessary to finance the appropriations made and expenditures authorized shall be provided out of the unencumbered cash balance in each fund, revenues other than taxation to be collected during the fiscal year in each fund, and tax levy requirements for each fund.

    Dated and passed this 14th day of September, 2023.

    Motion by Gifford to adopt Resolution 23 - 22. Second by Anderson. Roll call vote: Gifford yes; Darnall yes; Anderson yes. Motion carried.

    Budget hearing closed at 10:20 a.m.

  2. Chairperson Darnall opened Property Tax Hearing at 10:22 a.m. Chairperson Darnall opened the floor for public comments on the property tax hearing. No public comments. All members of the public wishing to address the governing body were provided a reasonable amount of time to do so. Resolution 23 - 23 read by Gifford: Resolution setting the property tax request:

    “Whereas Nebraska revised statute 77 - 1632 and 77 - 1633 provides that the governing body of the County of Banner passes by a majority vote a Resolution or ordinance setting the tax request; and

    Whereas a special public hearing was held as required by law to hear and consider comments concerning the property tax request;

    Now, therefore, the governing body of the County of Banner, resolves that:

    1. The 2023 - 2024 property tax request be set at $1,277,068.00.

    2. The total assessed value of property differs from last year's total assessed value by 6.912%.

    3. The tax rate which would levy the same amount of property taxes as last year, when multiplied by the new total assessed value of property, would be .399740 per $100 of assessed value.

    4. The county of Banner proposes to adopt a property tax request that will cause its tax rate to be .4276314 per $100 of assessed value.

    5. Based on the proposed property tax request and changes in other revenue, the total operating budget of the county of Banner will decrease last year's budget by .416%.

    6. A copy of this resolution be certified and forwarded to the County Clerk on or before October 15, 2023.
