                                                           Moratorium Resolution 26 - 01

 

            WHEREAS, the County of Banner, Nebraska has a comprehensive development plan; and

            WHEREAS, the County of Banner, Nebraska has seen an interest in Commercial and Industrial development; and

            WHEREAS there is the likelihood of additional commercial industrial development, the Banner County Board desires to review and research regulations which are appropriate for Banner County and its residents.

            WHEREAS the Banner County Board of Commissioners believe in the rights of individual landowners to make the best and most efficient use of their property and hereby state the intent of this moratorium is not to discourage the adoption and use of commercial and industrial facilities. Banner County Board of Commissioners specifically acknowledges utility of such facilities, especially within the ranching and agricultural industries, as well as utility to individual homeowners and fully support their continued use and proliferation in that regard.

            NOW THEREFORE, in consideration of the foregoing statements, the County Board of Banner County, Nebraska, hereby adopts the following resolution:

            BE IT RESOLVED, by the Banner County Board of Commissioner, Banner County, Nebraska, that a  county – wide twelve (12) month  moratorium be placed on any commercial and/or industrial development is hereby enforced, to allow the county to develop specific regulations, address citizen concerns about land use, water, and aesthetics, and to update the Comprehensive Plan with input from consultants. To include, but not limited to landfills, nuclear energy, any green energy (solar and/or wind), natural gas power plant(s), and/or salvage yard(s).  NOT to include any agricultural – related or livestock – related development.

            BE IT FURTHER RESOLVED, that this moratorium may be extended if necessary in order to allow the Banner County Planning Commission to conduct public meetings, including but not limited to public hearings, in direct regards to current and potential changes to regulations pertaining to any non – agricultural, non – livestock, industrial, and/or commercial development; and to further allow any potential changes to be passed on to the Banner County Board of Commissioners for review, approval, and/or disapproval with the same previously mentioned considerations as allowed for by the Banner County Planning Commission.

            BE IT FURTHER RESOLVED, that the Board of Commissioners of Banner County, Nebraska, hereby directs the Banner County Planning Commission to review the Banner County Comprehensive Planning regulations, to conduct hearings, if necessary, and to make specific recommendations for changes to the Banner County Board of Commissioners regarding regulations dealing with non – agricultural, non – livestock, industrial, and/or commercial development before accepting, granting, or recommending any permits for construction, and/or placement of cable/lines in county roads and/or county right – of ways for commercial and/or non – agricultural, non – livestock related industrial development.

            BE IT FURTHER RESOLVED, that the said twelve (12) month county – wide moratorium shall become effective as of the date of approval of this Resolution.
