Regular meeting of the Banner County Board of Commissioners.

The Banner County Board of Commissioners will consider, take necessary action, and may go into executive session (pursuant to Section 84-1410 of the Revised Statutes of Nebraska), when applicable. Any agenda item may be moved at any time at the discretion of the Chairperson of the Board. Public hearings will be called at the times noted.

The Chairperson of the Board may call agenda items out of order, however, public hearings as noted will be called at the times noted. The Banner County Board of Commissioners may discuss, consider, and take necessary action on agenda items listed. The Banner County Board of Commissioners reserves the right to convene in Executive Session pursuant to Section 84-1410 of the Revised Statutes of Nebraska.

Additions may not be made to this agenda less than 24 hours before the beginning of the scheduled meeting unless added as an '‘emergency item'‘. Emergency agenda items, as required by State Law, may be considered by the Banner County Board of Commissioners. An emergency is " a sudden unforeseen happening or event which calls for immediate action and remedy.'‘

The agenda shall be kept continually current and is available for public inspection at the Banner County Clerk's office during regular business hours.

Commissioners Proceedings

The Banner County Board of Commissioners met in regular session on Tuesday, May 21, 2024 at 4:45 p.m. in the courtroom of the Banner County Courthouse.

Notice of the meeting was published in the Western Nebraska Observer. A copy of proof of publication is on file in the office of the Banner County Clerk. Meeting notices posted in Harrisburg, Nebraska at: Post Office, Banner County School, and the Banner County Courthouse.

The agenda for the meeting was kept current and was available during the regular business hours at the office of the Banner County Clerk.  A copy was emailed to each board member on Monday, May 20, 2024.

  1. Chairperson Darnall called meeting called to order at 4:48 p.m.
  2. Clerk West took roll call, showing all Board members present.
  3. Chairperson Darnall announced a copy of the Nebraska Open Meetings Act is posted in the back of the courtroom by the entrance.
  4. Lease led prayer.
  5. Pledge of Allegiance was said.
  6. Consent Agenda:
    • Approval of Agenda: Motion by Anderson to approve agenda. Second by Lease. Roll call vote: Lease yes; Darnall yes; Anderson yes. Motion carried.
    • Adopt May 7, 2024 and May 8, 2024 Minutes: Motion by Lease to adopt May 7, 2024 minutes. Second by Anderson. Roll call vote: Lease yes; Darnall no; Anderson yes. Motion carried. Motion by Lease to adopt May 8, 2024 minutes. Second by Anderson. Roll call vote: Lease yes; Darnall yes; Anderson yes. Motion carried.
    • Correspondence:
      • Farm Service Agency - USDA: Lease stated letter suggests Banner County send out forms for foreign ownership of agriculture land. Lease stated it is not something that has to be done.
    • Claims: Moved to after “Items of Business”.
  7. Public Comments: Maddie Soule commented that she appreciates the minutes as written. Soule asked for a website update? Darnall reported the new website is finished and should be up soon. Soule stated concerns regarding squatters on property. Attorney Kovarik stated it is the responsibility for the landowners to inspect their property, if landowners suspect squatters, call law enforcement. Soule referenced Clerk West’s minutes that reported Darnall attending a meeting in Scottsbluff learning about zoning and how it works. Soule asked if that was something the Banner County Commissioners are looking to pursue? Darnall reported going to the Scotts Bluff County Commissioner meeting where Scotts Bluff County Commissioner’s were considering a special use permit for Situla Solar Panel Project in Scotts Bluff county. Darnall explained this decision by Scotts Bluff County Commissioner’s could affect Banner County as far as a road usage agreement. Darnall stated that the comment was “it was interesting to listen to the Scotts Bluff County Commissioners talk about their zoning and that process, but, no, we are not considering any zoning in Banner County that I am aware of. It was just interesting to learn that side and see how another county operates.”
  8. Items of Business Before the Board:
    • Appraiser Quote Discussion: Assessor Krakow reported having quotes from three appraisal companies. Values are to be set by March 19, 2025. Krakow hopes this will prevent another Show Cause Hearing, if all properties get reviewed and valued according to market value. Krakow stated a big increase in values. Krakow would like everything equalized throughout Banner County. Harrisburg had 30% blanket value and an added 28% increase. Rural residential had 10% blanket value and an added 28%, which has created inaccuracies with agricultural houses. State liaison is pushing for effective ages. Krakow stated this is county wide, a lot of things need corrected and reviewed before they are revalued. Krakow will get Commission and County Attorney appraiser contracts to review. Motion by Anderson to table until June 4, 2024. Second by Lease. Roll call vote: Lease yes; Darnall yes; Anderson yes. Motion carried.
    • Machine Hire: Pat Parsons stated he is available for dirt working services. Darnall suggested Banner County would need to advertise for bids if the Board decides to utilize a company to assist the county road department with dirt work.
    • Status Courthouse Glass Removal - Set Deadline Date: Darnall asked the status of the replacement glass. Lease reported talking to Thompson Glass, who will look at the project Wednesday. Discussion on different glass options. Motion by Anderson to table until June 4, 2024. Second by Lease. Roll call vote: Lease yes; Darnall yes; Anderson yes. Motion carried.
    • Claims: Motion by Lease to approve claims as presented. Second by Anderson. Roll call vote: Lease yes; Darnall yes; Anderson yes. Motion carried.
