Banner County Board of Commissioners Proceedings

            Banner County Board of Commissioners met in regular session Tuesday, September 1, 2026, at 8:45 a.m. in the courtroom of Banner County Courthouse. Notice of meeting was given by publication in Western Nebraska Observer.  A copy of the proof of publication is on file in Banner County Clerk's office.  Notices were also posted in Harrisburg, Nebraska Post Office; Banner County Public School; office of Banner County Clerk; and front window of Banner County Courthouse.

            Agenda is kept current and available during regular business hours in Banner County Clerk's office.  A copy of the agenda was sent to Board of Commissioners on Friday, August 28, 2026. 

            Chairperson Darnall called meeting to order at 8:45 am. Chairperson Darnall took roll call showing all members present.

Chairperson Darnall stated the Nebraska Open Meetings Act is posted by the back door of the courtroom. 

            Darnall led prayer

Pledge of Allegiance

            Motion by Anderson to approve agenda. Second by Darnall. Roll call vote: Anderson, yes; Darnall, yes; Lease, stepped away. Motion carried. 

            Motion by Anderson to approve minutes of August 31, 2026. Second by Darnall. Roll call vote: Darnall, yes; Anderson, yes; Lease, stepped away. Motion carried.

       Correspondence:

• Correspondence was examined. No action.

       Public Comment:

• None

Commissioner Reports: 

• Don Lease reported Daxton Davidson with Aptim will be in meeting later to discuss right – of – way permits.
• Robin Darnall reported budget workshop yesterday was productive and proposed budget was complete. Project Subcommittee for Comprehensive Planning Commission is working on address list for survey. No Region 22 Emergency Management meeting.
• Laif Anderson: No report.

      Items of Business Before the Board:

• Interview and Appoint Applicant for Clerk, Register of Deeds, Election Commissioner, and Clerk of District Court Position: Darnall mentioned Register of Deeds and Clerk of District Court potential interlocal agreement with Scottsbluff County. Discussion on potential interlocal agreements and filling positions. Board conducted interviews of three applicants, Chairty Sours, Chasta Lambert, and Monica Jensen. Motion by Lease to appoint Chasta Lambert as temporary interim Clerk, Register of Deeds, Election Commissioner, and Clerk of District Court at current salary for said position. Second by Anderson. Roll call vote: Anderson, yes; Darnall, yes; Lease, yes. Motion carried.
• Review, Accept, and Sign 2026 Inventory: Board has reviewed inventories. Motion by Lease to approve 2026 inventories. Second by Anderson. Roll call vote: Lease, yes; Anderson, yes; Darnall, yes.  Motion carried.
• Approval of Surplus Two Trailers on Purple Wave Auctions: Jay Dove, Road Foreman, presented details for two trailers to be listed as surplus and sold on Purple Wave Auctions. Hyster LoBoy trailer and a tilt bed trailer are unusable. Motion by Anderson to surplus two trailers on Purple Wave Auctions a 1965 Hyster LoBoy trailer and a 2017 Tilt Bed trailer. Second by Lease. Roll call vote: Darnall, yes; Lease, yes, Anderson, yes. Motion carried.
• Discussion of Changes for Policy: Permit to Occupy Road Right – of – Way in Banner County: Lease discussed modifications to Permit to Occupy Road Right – of – Way to conform more to Kimball County. Lease discussed United States Air Force cannot sign off on Right – of – Way permit, Contractors may sign off. Daxton Davidson (Aptim) and Martin Reed (Army Corp of Engineers) were present and discussed changes to Banner County Right – of Way permit. Discussion on ownership of buried lines, bonds, and maintenance on Banner County roads. Board requested proposed changes to permit and County Attorney to review permits. No action.
• Approval of Changes for Permit to Occupy Right – of – Way Permit to Occupy Right – of Way in Banner County: No action.
• Appoint Personnel Policy Committee Members: Darnall mentioned some members of Personnel Policy Committee have left county employment. Laif Anderson remains on Personnel Policy Committee. Motion by Anderson to appoint Chasta Lambert (County Clerk) and Taylor Martinez (Assessor) to Personnel Policy Committee. Second by Darnall. Roll call vote: Anderson, yes; Lease, yes; Darnall, yes. Motion carried.
• Approve, Sign, and Return to Project Committee – Banner County Survey Cover Letter Regarding Comprehensive Plan: Darnall explained cover letter that will accompany county wide survey. Project Committee discussed if landowners, voters, and businesses received a letter from Banner County Board of Commissioners, there may be more responses. Discussion on letter contents and recipients of letter. Motion by Anderson to approve cover letter to be signed by Commissioners. Second by Lease. Roll call vote: Lease, yes; Anderson, yes: Darnall, yes. Motion carried.
• Review/Discuss/Approve Resolution 26 – 30 Petty Cash Resolution: Resolution 26 – 30 Petty Cash Resolution read by Anderson. Motion by Anderson to approve Resolution 26 – 30 Petty Cash Resolution as read. Second by Lease. Roll call vote: Lease, yes; Darnall, yes; Anderson, yes. Motion carried.
• Review/Discuss/Approve Resolution 26 – 31 Tax Allocation to Miscellaneous Districts Resolution: Lease read Resolution 26 – 31 Tax Allocation to Miscellaneous Districts Resolution. Motion by Lease to approve Resolution 26 – 31 Tax Allocation to Miscellaneous Districts Resolution as read. Second by Anderson. Roll call vote: Darnall, yes; Anderson, yes; Lease, yes. Motion carried.

General: Hometown Leasing $138.64 – copier lease; JEO Consulting $2,534.50– comprehensive plan survey; Kimball County Treasurer $1,759.60 – extension office; Nebraska County Attorney’s Association $550 – training; US Bank $411.63 – elections postage, office supplies, and fuel; Westco $554.46 – repair parts; Triade $7,697.11 – employee health insurance; Banner Capitol Bank $4,094.80 – employee health savings accounts; Vision Service Plan $202.63 – employee vision insurance; Aflac $998.70 – employee benefits; Aflac Dental $565.65 – employee benefits.. Total = $19,507.72

Sheriff: US Bank $630.72 – travel, fuel, and office supplies; Zane Hopkins $92.37 – meal reimbursement.

Road: US Bank $411.95 – fuel and office supplies; High West Energy $323.00 – lights; North Platte Natural Resources District $31.42 – water; J & M Construction $37,500.00 – crack seal courthouse parking lot; Triade $4,626.51 – employee health insurance; Colonial Life $29.48 – employee dental benefits; Banner Capitol Bank $1,458.35 – employee health savings accounts; Vision Service Plan $202.63 – employee vision benefits; Westco $6,045.73 – fuel; Nebraska Machinery CAT $5,442.89 – parts and labor. Total = $56,666.76

Motion by Lease to approve claims as presented. Second by Anderson. Board discussed signatures for payment of payroll and claims. Nebraska Association of County Officials legal council was contacted for advice. Darnall will visit Banner Capitol Bank and MIPS to be certain paperwork is completed, and claims be paid in a timely manner. Signatures for Banner Capitol Bank will be addressed September 15, 2026, Board of Commissioners meeting. Roll call vote: Lease, yes; Darnall, yes; Anderson, yes. Motion carried

Chairperson Darnall adjourned meeting 2:17 pm.

      Next regular Board of Commissioners meeting will be September 15, 2026, at 8:45 am or at the call of Banner County Clerk. Agenda for matters to be considered on such date and time is kept continually and is available for public inspection during normal business hours at Banner County Courthouse in Harrisburg, Nebraska.
