Moratorium Resolution 26 –02
WHEREAS, Banner County, Nebraska, has a comprehensive development plan; and
WHEREAS, the Banner County, Nebraska, has seen an increase in interest for Commercial and Industrial development; and
WHEREAS there is an increasing likelihood of large-scale commercial and or industrial development as a result of this interest, and Banner County must now begin to review the possibility of establishing and implementing land use regulations which are appropriate for Banner County and its residents.
NOW THEREFORE; in consideration of the foregoing statements, Banner County, Nebraska, hereby adopts the following resolution:
BE IT RESOLVED; by the County Commissioners of Banner County, Nebraska,
- That a twelve (12) month moratorium regarding commercial and/or industrial development be enacted and implemented throughout all of Banner County, Nebraska, to better allow Banner County to consider and develop rural land use regulations that adequately address citizen concerns including but not limited to: current and future land use, water use, aesthetics, regional landfills, nuclear energy, alternative energy forms (such as wind and solar energy), natural gas power plant(s), and salvage yard(s), while still protecting Banner County values and its way of life;
- This moratorium shall be applicable to all non-agricultural, non-livestock producing, and non-military, business, industrial, and/or commercial development in all of Banner County, it shall not apply to residential development;
- This moratorium may be extended, if necessary, in order to allow Banner County to conduct public meetings, to consult with land use professionals, and properly evaluate current and potential changes to land use regulations in Banner County;
- That the Banner County, Nebraska Board of Commissioners hereby directs the Banner County Planning Board to evaluate current regulations, consider and/or develop intelligent and practical land use regulations consistent with the Banner County
Comprehensive Plan that protect and preserve the values and way of life in Banner County, Nebraska, and to make regular reports of its progress in addition to any specific findings and/or recommendations related to land use regulations in Banner County to the Banner County Board of Commissioners;
- That the said twelve (12) month county-wide moratorium shall become effective as of the date of the passage, approval, and publication of this Resolution as provided by Nebraska Law.
BE IT FURTHER RESOLVED; This moratorium does NOT include agricultural production development, livestock production development, and United States Military development consistent with the current Banner County Comprehensive Plan and the Banner County way of life; nor is it intended to restrict development/improvement of existing utility services already installed in Banner County Nebraska or future development.
