Resolution 26 – 06
A Resolution to Establish an Indigent Burial Program and Fund Limits by the Banner County Board of Commissioners, the Governing Body of Banner County, Nebraska
WHEREAS, Banner County will consider providing short-term cremation assistance for any person who dies within the geographic boundaries of Banner County or who has legal settlement in Banner County.
WHEREAS, payments may be authorized directly to any mortuary within Kimball County, Nebraska, Scotts Bluff County, Nebraska, Laramie County, Wyoming, and Goshen County, Wyoming, if the estate of the decedent and/or financial resources of the responsible relative(s), as defined by Nebraska Statute 38-1425, is/are insufficient to pay for the cost.
WHEREAS, it is the policy of Banner County that cremation is the only option available, exceptions to this policy are only for those situations where cremation is not an option due to legal considerations.
WHEREAS, if the estate of the decedent and/or the income and resources of the responsible party, is/are insufficient to meet the cremation expenses cremation assistance may be authorized to meet these expenses. Under no circumstances shall the cremation expenses provided by Banner County be supplemented by a private/non-profit payer. Violation(s) of these conditions will forfeit Banner County’s responsibility for participation in the costs of the cremation expenses provided.
WHEREAS, financial eligibility requirements: In order to be eligible for cremation assistance are as follows:
- The gross income of the responsible party(ies) must be equal to or below 100% of the poverty guidelines set forth by the Department of Health and Human Services (DHHS); and
- The assets of the decedent’s estate and/or the income and resources of the responsible party(ies) cannot exceed the allowable fee schedule.
IT IS THEREFORE RESOLVED by the Board of Commissioners of Banner County, Nebraska that Banner County set the indigent burial cost not to exceed one thousand five hundred dollars ($1,500.00) for applicant(s)/responsible party(ies) who meet the financial eligibility requirements set forth above upon proper application, proof, and verification of the same.
