BANNER COUNTY DECLARATION AS A RULE OF LAW COMMUNITY

WHEREAS, the Federal Government under the provisions of the Immigration and Nationality Act as codified in the United States Code is responsible for the establishment and enforcement of the laws of the United States of America as they pertain to legal immigration, and

WHEREAS, the authority for enforcement of the Immigration and Nationality Act and the U.S.C. is vested with the Federal Government, and it is the responsibility of all levels of government to fully support the Federal Government in the exercise o its obligations under the law pertaining to immigration, and

WHEREAS, we believe our Banner County Sheriff's Department needs to cooperate with ICE trained personnel in our local county to help identify suspected violators of Federal Immigration laws, and, Banner County, Nebraska should consider and approve local measures that further define Banner County as a rule of law county with regard to upholding federal immigration laws,

WHEREAS, the Banner County Board of Commissioners hereby supports enforcement of federal immigration laws through adoption of local measures within the scope of local authority in accordance to the state and U.S. Constitutions;

THEREFORE, NOW BE IT RESOLVED:. The Banner County Board of Commissioners hereby declare that Banner County, Nebraska is not a sanctuary community for undocumented illegal aliens and is a rule of law county in regard to upholding our nation's immigration laws.

Moved for approval and adoption by Anderson.  Second by Darnall.
